The act exempts \u201cqualified\u201d tipped wages\u2014such as cash tips, credit\/debit\u2010card tips, checks, and shared or pooled tips\u2014from federal <strong data-start=\"450\" data-end=\"464\">income tax<\/strong> by allowing workers to claim a 100% deduction when they file.  Cruz framed the law as a way to protect service\u2011industry workers\u2014waitstaff, bartenders, delivery drivers, nail techs, and others\u2014who often rely heavily on tips to make ends meet.<\/p>\n<p data-start=\"783\" data-end=\"1367\">Under the bill\u2019s terms, there\u2019s a <strong data-start=\"817\" data-end=\"832\">$25,000 cap<\/strong> on deductible tip income per taxpayer, with eligibility restricted to individuals in traditionally tipped professions.  The legislation also places an <strong data-start=\"1021\" data-end=\"1041\">income phase-out<\/strong>, disallowing the full deduction for higher earners\u2014specifically those making more than $160,000 (per the Senate version).  These \u201cguardrails\u201d were designed to prevent abuse and ensure the benefit goes to workers who genuinely depend on tip-based pay.<\/p>\n<p data-start=\"1369\" data-end=\"1727\">In addition to the deduction for workers, the bill expands a <strong data-start=\"1430\" data-end=\"1453\">business tax credit<\/strong> for payroll taxes paid on tips\u2014particularly in beauty services like barbering, esthetics, nail care, and spa work. This aims to help small businesses in tip-heavy industries, ensuring they\u2019re not penalized for employing tipped workers.<\/p>\n<p data-start=\"1729\" data-end=\"2284\">There are important differences between the Senate and House versions of the bill. In the House, the deduction would reportedly <strong data-start=\"1857\" data-end=\"1875\">expire in 2028<\/strong>, while the Senate version does <em data-start=\"1907\" data-end=\"1912\">not<\/em> include an expiration date. Also, the House version has no $25,000 cap, allowing for a full deduction of reported tips; the Senate version\u2019s cap limits the benefit.  The Senate version is also limited to W-2 employees, excluding many independent contractors.<\/p>\n<p data-start=\"2286\" data-end=\"2984\">Observers have raised a few criticisms. Some economists and labor advocates warn that exempting tip income could <strong data-start=\"2399\" data-end=\"2447\">incentivize employers to suppress base wages<\/strong>, leaning more on tips\u2014and potentially exacerbating the low nominal wage issue in tipped sectors.  There\u2019s also concern about who benefits the most: higher\u2011earning tipped workers could take full advantage of the deduction, while very low-income workers (who already pay little or no income tax) may not see as much of a payoff. \u00a0Critics also worry about potential expansion of the tipped-wage model into new industries.<\/p>\n<p data-start=\"2986\" data-end=\"3484\">Finally, the bill directs the <strong data-start=\"3016\" data-end=\"3039\">Treasury Department<\/strong> to issue, within 90 days, a formal list of qualifying \u201ctipped occupations\u201d (jobs that regularly received tips before 2024). This list will help define exactly which workers can use the deduction, aiming for clarity and consistency.
