Under that standard, an employer could deny a request if the accommodation imposed even minimal inconvenience or cost \u2014 \u201cde\u202fminimis\u201d meaning small or trivial. \u00a0In practice, this meant that minor scheduling conflicts, modest shift rearrangements, or slight coworker disruptions often were sufficient grounds for denial. As critics long argued, this low threshold effectively rendered religious accommodations optional and fragile, allowing employers to treat religious practice as a burden rather than a protected right.<\/p>\n<p data-start=\"958\" data-end=\"1564\">That changed on <strong data-start=\"974\" data-end=\"991\">June\u202f29,\u202f2023<\/strong>, when the Court unanimously ruled in Groff v. DeJoy that the de\u202fminimis standard was a misinterpretation of Title VII. Instead, the Court clarified, employers wishing to deny a religious\u2011accommodation request must demonstrate that granting it would impose a <em data-start=\"1250\" data-end=\"1280\">\u201csubstantial increased cost\u201d<\/em> relative to the business.  The Court emphasized that \u201chardship\u201d must mean something more serious than a mere small burden \u2014 \u201csomething hard to bear,\u201d \u201cexcessive,\u201d or \u201cunjustifiable\u201d\u2014 not something trifling.<\/p>\n<p data-start=\"1566\" data-end=\"2116\">Under this new standard, employers must look at the full context \u2014 including their size, resources, operating costs, and the nature of the requested accommodation \u2014 before denying.  The decision also clarified that discomfort, animosity, or dislike from coworkers toward the religious observance cannot by itself justify denial.  What matters is whether the burden truly affects the employer\u2019s business operations \u2014 not whether other employees are unhappy or inconvenienced.<\/p>\n<p data-start=\"2118\" data-end=\"2729\">This ruling does <strong data-start=\"2135\" data-end=\"2142\">not<\/strong> mean that employers must grant every accommodation request. Rather, it recalibrates the balance in favor of religious freedom: accommodation requests now deserve serious, good\u2011faith consideration, not automatic dismissal based on minor inconvenience. Courts are expected to conduct \u201cfact\u2011specific inquiries\u201d on a case\u2011by\u2011case basis.  Employers may still deny on valid grounds \u2014 but only when they can show a substantial hardship. Prior reflexive denials based on de\u202fminimis conflicts should no longer suffice.<\/p>\n<p data-start=\"2731\" data-end=\"3354\">Supporters of the decision have hailed it as a much\u2011needed reaffirmation that religious liberty in the workplace is not merely theoretical \u2014 that personal faith and employment should not be pitted against each other lightly.  For employees who observe weekly Sabbaths, religious holidays, prayer times, or other practices, the ruling promises more predictable, fairer treatment. It also encourages employers to engage more creatively \u2014 by exploring shift swaps, schedule adjustments, or other accommodations \u2014 instead of defaulting to denial.<\/p>\n<p data-start=\"3356\" data-end=\"4085\">At the same time, the decision introduces a new dynamic into employment law and workplace management. Because the Court did <strong data-start=\"3480\" data-end=\"3487\">not<\/strong> adopt a rigid definition of \u201csubstantial hardship,\u201d lower courts will now be called on to interpret what counts \u2014 creating a period of uncertainty as case law develops.  Employers may need to update policies, train supervisors, and document accommodation\u2011decision processes carefully. On the other side, employees may feel more confident requesting accommodations, but may still face pushback where businesses argue legitimate hardship.
