The decision bolstered executive authority on border control and marked a pivotal moment in ongoing national debates over immigration and federal power."},"content":{"rendered":"<p data-start=\"100\" data-end=\"1080\">The Supreme Court of the United States (SCOTUS) recently issued a decision that dramatically reshapes the fate of eight immigrants held at a U.S. military base in Djibouti, effectively clearing the way for their deportation to South Sudan \u2014 a country known for civil conflict, extreme instability, and ongoing human rights abuses.  The eight men had been initially slated for deportation under the government\u2019s \u201cthird\u2011country removal\u201d policy \u2014 which allows U.S. authorities to send noncitizens to countries other than their homeland when direct repatriation is not feasible.  But a lower\u2011court judge, Brian E. Murphy, previously blocked such removals \u2014 especially to countries where the deportees were unlikely to have meaningful ties \u2014 unless they were first given notice and a fair opportunity to contest the transfer based on fears of torture or other grave harm.<\/p>\n<p data-start=\"1082\" data-end=\"2051\">In his April 18, 2025 injunction, Judge Murphy ruled that the government could not send immigrants to third countries that were not explicitly named in their removal orders without first offering due process \u2014 namely, written notice of the destination country, and a meaningful chance to seek protection under the Convention Against Torture (CAT), which prohibits deportation to a place where the person could face torture or death. \u00a0The urgency of the conflict came into sharp relief in May, when eight men convicted of serious crimes in the U.S. \u2014 from countries including Cuba, Vietnam, Laos, Mexico, Myanmar, and South Sudan \u2014 were being flown to South Sudan, only to have their flight diverted to Djibouti after the court\u2019s injunction.  Murphy then issued a remedial order requiring meaningful safety hearings for the men before any further transfer.<\/p>\n<p data-start=\"2053\" data-end=\"2802\">But on June 23, 2025, the Supreme Court \u2014 on emergency review and via its so\u2011called \u201cshadow docket\u201d \u2014 issued a brief, unsigned order staying Murphy\u2019s injunction, thereby allowing the government to resume third\u2011country removals immediately while litigation continued.  When Murphy tried to enforce his separate May remedial order for these eight detainees in Djibouti, the Administration returned to the Supreme Court. In a 7\u20132 decision issued shortly afterward, the Court clarified that once the underlying injunction was stayed, the remedial order enforcing it lost all effect \u2014 meaning the government no longer needed to follow Murphy\u2019s safety\u2011protection procedures.<\/p>\n<p data-start=\"2804\" data-end=\"3503\">Although some justices dissented, notably Sonia Sotomayor along with Ketanji Brown Jackson, arguing that the Court\u2019s ruling enabled the government to deport people to danger zones without due process or meaningful review, the majority\u2019s decision cleared the way for the removals. Within days, the men were transported to South Sudan. The Trump administration, through the U.S. Department of Homeland Security (DHS), described the outcome as a vindication of its authority to deport noncitizens \u2014 including those with violent criminal records \u2014 even if the destination nation is not the individuals\u2019 country of origin.<\/p>\n<p data-start=\"3505\" data-end=\"4598\">The ruling has ignited fierce controversy and broader debate over the balance between sovereign deportation powers and human rights protections. Advocates for the detainees and immigrant rights groups warn that sending people to countries with active conflict, widespread violence, and unstable security \u2014 like South Sudan \u2014 without adequate safeguards violates international obligations under CAT and undermines due process protections guaranteed by the U.S. Constitution. \u00a0On the other side, supporters within the administration argue that third\u2011country removals are a necessary component of enforcing immigration law \u2014 especially in cases where the home country refuses repatriation, or where diplomatic arrangements provide alternative destinations willing to accept deportees. They claim that extended judicial oversight in every case would cripple the government\u2019s ability to carry out deportations efficiently, especially in contexts where national security and foreign\u2011policy considerations are involved.<\/p>\n<p data-start=\"4600\" data-end=\"5592\">In the larger context, the case represents a turning point for U.S. immigration law: the Supreme Court\u2019s decision sets a precedent that lower courts may not impose human\u2011rights safeguards or procedural protections that interfere with the executive branch\u2019s discretion \u2014 at least in third\u2011country removal cases. It highlights how the Court\u2019s use of emergency orders on its \u201cshadow docket\u201d can resolve politically and morally fraught issues with little public explanation or transparency. Many legal scholars warn the decision could open the door to more frequent deportations to unstable or dangerous countries \u2014 without meaningful individual review \u2014 while undermining judicial checks on executive deportation power.
