U.S. District Judge James Boasberg, an Obama appointee, reportedly displayed frustration during a hearing on Thursday, smirking and rolling his eyes at DOJ attorneys.
Boasberg, who previously blocked parts of the Trump administration’s deportation policy, issued a restraining order against the use of the 1798 Alien Enemies Act and attempted to halt deportation flights, including those carrying alleged gang members. He warned administration officials they could face contempt charges for allegedly defying the court’s order.
The administration has appealed the case to the Supreme Court, while Boasberg considers whether to initiate contempt proceedings. Reporter Julie Kelly noted the judge’s visible bias, including theatrical gestures and expressions.
During the hearing, Boasberg questioned Deputy Assistant Attorney General Drew Ensign on deportation flights and accused the government of acting in bad faith. He may decide on contempt proceedings as early as next week.
