The Trump administration appealed to the U.S. Supreme Court regarding the Alien Enemies Act, used to expedite the deportation of individuals linked to a Venezuelan gang.
The appeal challenges a ruling by U.S. District Judge James Boasberg, which temporarily halted deportations under the Act.
Acting Solicitor General Sarah Harris argued the case raised key questions about presidential versus judicial authority over national security. The case revolves around Trump’s invocation of the 1798 law, which allows the deportation of undocumented immigrants during wartime.
Over 200 Venezuelans were deported, some under different legal provisions. Following Boasberg’s ruling, Trump filed an appeal, which was upheld by the DC Circuit Court. Trump is now seeking Supreme Court intervention, with some conservative judges supporting his interpretation of “invasion.”
