Supreme Court Backs FDA’s Denials Of Flavored Vaping Products For Now

The U.S. Supreme Court upheld the FDA’s decision to block flavored vaping products, marking a significant win for government regulators in limiting access to such products.

 

The ruling could make it harder for people to get these products, though vaping companies may reapply for approval.

While the Biden administration’s FDA rejected many flavored products, the vaping industry argued that the agency changed its rules midway through the approval process.

Public health groups praised the decision, emphasizing its role in protecting youth from nicotine addiction.

The case will be reconsidered by an appeals court, and vaping companies could reapply for approval under a future administration.
