Veteran legal analyst Alan Dershowitz criticized U.S. District Judge James Boasberg’s move to pursue contempt charges against the Trump administration, calling it likely to fail.
Boasberg, an Obama appointee, issued a temporary hold on Trump’s use of the Alien Enemies Act to deport gang members like those from Tren de Aragua.
When the administration deported them anyway—on a flight already en route to El Salvador—Boasberg threatened contempt charges. The Supreme Court later overturned his order.
Dershowitz argued Boasberg’s directive was vague and lacked a binding written order, which is necessary for contempt. He suggested the judge himself should be held in contempt for overreach.
Meanwhile, Rep. Brandon Gill (R-TX) introduced articles of impeachment against Boasberg, accusing him of blocking Trump’s lawful deportations and creating a constitutional crisis. Critics say the judge’s actions demonstrate bias against the administration’s immigration policy.
