Following a federal judge’s ruling in New York that bars deportations without due process, former President Donald Trump
criticized the decision, claiming it’s unfeasible to hold trials for the millions of undocumented migrants in the U.S. He argued the immigration system can’t handle the volume and emphasized the threat posed by dangerous individuals, including gang members and drug traffickers.
Trump’s border enforcement chief, Tom Homan, supported these claims, stating many targeted for deportation already have removal orders. He highlighted the case of Kilmar Abrego Garcia, deported despite past gang affiliations, and noted the Supreme Court ordered his return, despite two rulings labeling him MS-13.
Homan rejected claims of government misconduct, insisting Garcia received due process. He also blamed the Biden administration for overwhelming the system and delaying enforcement.
Separately, the Supreme Court ruled 5-4 in Monsalvo Velazquez v. Bondi that if a voluntary departure deadline falls on a weekend or holiday, it extends to the next business day. Justice Gorsuch, writing for the majority, said this aligns with standard immigration procedures.
