SCOTUS Won’t Take Up New Dispute Over ‘Independent State Legislature’ Theory

The U.S. Supreme Court rejected Montana Republicans’ effort to revive two election laws using the “independent state legislature” theory, affirming that state courts can review election laws, though with limits. Montana’s laws had banned same-day voter registration and paid ballot collection on Election Day.
 
The Court also declined to hear major gun rights cases, including challenges to Delaware’s ban on assault weapons and Maryland’s handgun licensing law, leaving lower court rulings in place. Despite its conservative majority, the Court chose not to weigh in on these contentious Second Amendment issues.
