Judge Approves Trump’s Use of Alien Enemies Act for Deportations
A federal judge has ruled that President Trump can invoke the Alien Enemies Act (AEA) to deport Venezuelan nationals allegedly linked to the Tren de Aragua gang, which the administration has labeled a Foreign Terrorist Organization. U.S. District Judge Stephanie Haines upheld most of Trump’s proclamation but ordered improved notice for those facing removal.
Trump’s use of the 1798 AEA marks its first modern application outside of wartime. The administration has already deported over 260 individuals, with some sent to El Salvador.
Legal challenges continue, with the ACLU arguing due process violations. While Judge Haines acknowledged the law’s authority, she warned the administration must provide greater notice to those targeted for deportation under the statute.
