President Donald Trump praised a federal appeals court decision that allowed him to continue the deployment of the California National Guard in Los Angeles amid ongoing unrest. “If I didn’t send the Military into Los Angeles, that city would be burning to the ground right now,” Trump posted on Truth Social. “We saved L.A. Thank you for the Decision!!!” The 9th Circuit Court of Appeals granted the Trump administration’s request to stay a ruling by U.S. District Judge Charles Breyer. Breyer had concluded that Trump’s move to federalize parts of the California National Guard violated the Tenth Amendment and exceeded his statutory authority. He ordered the troops returned to Governor Gavin Newsom but delayed enforcement until noon Friday to allow for appeal. The appeals court acted before the deadline and scheduled a hearing for Tuesday.
California had filed a lawsuit against Trump, the Department of Defense, and Defense Secretary Pete Hegseth to restrict federal use of the Guard without gubernatorial approval. Former House Speaker Nancy Pelosi criticized the deployment, incorrectly referencing “Article 10” of the Constitution, which does not exist. Analysts later clarified she likely meant Title 10 of the U.S. Code, which governs the federal activation of the National Guard. Legal scholars noted that longstanding Supreme Court precedent supports the president’s authority to federalize Guard units without state consent. The legal battle highlights deep divisions over federal authority, states’ rights, and the limits of executive power in domestic military deployments.
