Republicans on Capitol Hill are moving swiftly to issue a criminal referral against Dr. Anthony Fauci, alleging he benefited from a scheme to bypass former President Joe Biden by using the White House autopen to secure a pardon.
Leading the charge is Sen. Rand Paul (R-KY), who announced Monday that he is referring Fauci to Attorney General Pam Bondi and the Department of Justice after it was revealed Fauci’s pardon was signed via autopen rather than Biden’s direct signature.
This revelation came from a New York Times investigation into Biden’s final weeks in office, which showed that then-White House Chief of Staff Jeff Zients approved last-minute pardons—including for Fauci and members of the January 6 Select Committee, like former Rep. Liz Cheney. Zients emailed, “I approve the use of the autopen for the execution of all of the following pardons,” after presenting a list to Biden.
President Donald Trump has called on Republicans to investigate whether autopen-signed pardons are legally valid. Normally used for routine documents, the autopen’s extensive use in Biden’s final days raised questions amid concerns about the president’s mental fitness.
Republicans see this as a chance to scrutinize Fauci, Cheney, and Biden family members pardoned on the last day. Trump has vowed legal action against Fauci over COVID-19 handling and Cheney for her role on the January 6 Committee. Republicans also accuse Fauci of hiding evidence about a lab leak origin of the coronavirus and evading public records laws, based on internal NIH emails.
